Terms and Conditions: 5% Deposit Paid Promotion (Victoria)

Selected MunCorp complete homes  ·  Rebate of 5% of the contract price, up to $30,000 per purchase, applied at settlement

Promoter: MunCorp (and its related entities that are the vendor of a Qualifying Home) (“MunCorp”, “we”, “us”).

Promotion: “5% Deposit Paid” on selected MunCorp complete homes sold under a single (one-part) contract.

Cap: The rebate is 5% of the contract price, up to a maximum of $30,000 per purchase.

Websites: fhb.muncorp.com.au and muncorp.com.au

These terms apply to the Promotion. By signing a contract of sale that includes this offer, you accept these terms. They sit alongside the contract of sale. If there is a conflict, the signed contract of sale prevails.

1. What the offer is

1.1  The Promotion is a vendor rebate / purchase-price discount equal to 5% of the contract price of a Qualifying Home, capped at $30,000 per purchase.

1.2  The amount applied at settlement is the lesser of: (a) 5% of the contract price; and (b) $30,000.

1.3  Examples only:

         •  Contract price $500,000  →  5% = $25,000  →  rebate $25,000.

         •  Contract price $600,000  →  5% = $30,000  →  rebate $30,000.

         •  Contract price $700,000  →  5% = $35,000  →  rebate $30,000 (cap applies).

1.4  The rebate is not cash paid to you as a deposit, not a gift of funds, and not the Australian Government 5% Deposit Scheme (Home Guarantee Scheme). It is a MunCorp commercial incentive.

1.5  The rebate is applied only at settlement as a credit against the balance of the purchase price then owing. You must still pay any deposit required under the contract of sale in the usual way (unless the contract expressly says otherwise).

2. Eligible properties

2.1  The offer applies only to selected MunCorp complete homes nominated by MunCorp in writing as participating in this Promotion (“Qualifying Homes”).

2.2  “Complete home” means a dwelling sold under a single (one-part) contract of sale for the completed home package as offered by MunCorp. Land-only lots, separate land-and-build contracts, and homes not expressly marked as participating do not qualify unless MunCorp confirms otherwise in writing.

2.3  Participating homes, designs, lots, estates and price points may change. Availability is limited and first-come, first-served while stock lasts.

2.4  MunCorp may withdraw a home from the Promotion at any time before you and MunCorp have both signed a binding contract of sale that records the rebate.

3. Who can use the offer

3.1  The purchaser must be a natural person (or persons) entering a contract of sale as purchaser of a Qualifying Home.

3.2  The offer is aimed at first-home buyers but is not limited to first-home buyers unless the particular contract or campaign material for that home says it is. Eligibility for government grants, stamp duty concessions or the Home Guarantee Scheme is separate and is your responsibility.

3.3  Companies, trusts, SMSFs, builders, and related-party or employee purchases may be excluded at MunCorp’s discretion unless approved in writing.

3.4  Limit: one rebate per Qualifying Home and one rebate per purchaser / household for this Promotion, with a maximum of $30,000 per purchase, unless MunCorp agrees otherwise in writing.

4. How you get the rebate

You only receive the rebate if all of the following are met:

  • You sign an unconditional (or then-becoming-unconditional) contract of sale for a Qualifying Home during the promotional period MunCorp specifies for that home.
  • The contract records the 5% settlement rebate / discount, subject to the $30,000 cap (or attaches these terms).
  • You pay all deposits and other amounts due under the contract on time.
  • You obtain finance (if the contract is subject to finance) and satisfy every other condition of the contract.
  • Settlement completes on the due date (or any extended date MunCorp agrees in writing).
  • You are not in default under the contract at settlement.
  • The sale is not terminated, rescinded or assigned without MunCorp’s written consent.

If any of the above fails, the rebate lapses and no compensation is payable.

5. How the rebate is paid

5.1  The rebate is applied only at settlement as a reduction of the balance purchase price on the settlement statement.

5.2  It is not paid in cash, by EFT, as a rent credit, or as a post-settlement cheque, except if MunCorp elects in writing to do so.

5.3  The rebate is calculated on the contract price of the Qualifying Home (inclusive of GST if GST is included in that price), then capped at $30,000. It is not calculated on extras, variations, upgrades, legal fees, stamp duty, adjustments, or government charges unless the contract says so.

5.4  If the contract price is varied, MunCorp may recalculate the rebate as 5% of the final contract price, still not exceeding $30,000.

5.5  The rebate cannot be transferred, assigned, split across lots, or used on another property. Multiple purchasers on one contract share the same single cap of $30,000.

6. Finance, valuation and government schemes

6.1  Lenders treat vendor rebates differently. Some may reduce the usable loan amount, treat the rebate as a price reduction, or require a larger genuine savings contribution. You must confirm with your broker or lender before you sign.

6.2  This Promotion is independent of:

  • the Australian Government Home Guarantee Scheme;
  • the First Home Owner Grant;
  • Victorian or other stamp duty concessions; and
  • any other government incentive.

Using those schemes with this rebate is not guaranteed and may not be allowed by the relevant authority or your lender.

6.3  Stamp duty, land tax, GST, adjustments and legal costs are your responsibility except where the contract provides otherwise. A price rebate can change the dutiable value. Obtain advice from your conveyancer.

7. Other offers

7.1  Unless MunCorp agrees in writing, this Promotion cannot be combined with other MunCorp rebates, price reductions, furniture packages, rental guarantees, or agent incentives on the same home.

7.2  Advertised “5% deposit paid” or “up to $30,000” figures are the maximum under these terms. The actual credit is the lesser of 5% of that home’s contract price and $30,000.

8. Changes, stock and withdrawal

8.1  MunCorp may amend, suspend or end the Promotion at any time for unsold homes.

8.2  Images, floorplans, prices and campaign copy on fhb.muncorp.com.au and related advertisements are indicative only. The signed contract, plans and specifications control.

8.3  Construction timing, titles and settlement dates remain as set out in the contract of sale.

9. Default and termination

If you default and the contract is terminated, you are not entitled to the rebate or any part of it, and MunCorp may rely on its rights under the contract (including in relation to the deposit).

10. Privacy and marketing

Personal information collected in connection with this Promotion is handled in accordance with MunCorp’s privacy policy on muncorp.com.au. Campaign pages (including the first-home-buyer landing page) may use analytics and advertising cookies.

11. Advice and liability

11.1  This document is a promotional term sheet, not legal, tax or finance advice. Obtain independent conveyancing and lending advice before you sign.

11.2  To the extent permitted by law, MunCorp is not liable for lender decisions, government scheme eligibility, valuation outcomes, or tax or duty consequences of applying the rebate at settlement.

11.3  Nothing in these terms excludes rights you cannot contract out of under the Australian Consumer Law.

12. General

12.1  These terms are governed by the laws of Victoria, Australia.

12.2  If a provision is invalid, the rest remains in force.

12.3  “Including” means “including without limitation”.

12.4  Notices may be given as allowed under the contract of sale.

5% deposit paid is a vendor rebate of 5% of the contract price, up to $30,000 per purchase, applied at settlement on selected MunCorp complete homes sold under a single contract. Not cash. Not the government 5% deposit scheme. Limited stock. Terms apply.
